TERMS AND CONDITIONS

Any order placed by private customers with Deco for Curious at www.decoforcurious.com is subject without limitation to these Terms and Conditions. Private customers are defined as private individuals who restrict the use of products to their own personal needs or those of their family and friends.

ORDERING

All available products are shown on the corresponding page of www.decoforcurious.com unless indicated as out of stock.

PRICE OF ITEMS

The prices applicable to the products are those shown at the time of the order and all carry the taxes (VAT or similar) included. The breakdown of these taxes will be broken down before the completion and formalization of the order. You must take into account that when you formalize the order, the system will inform you in detail of the total taxable base of the order, the taxes that can be charged and the corresponding shipping costs.

The taxes, fees and shipping costs will vary depending on the tax or physical area from which the order is made or has to be sent, so it can be modified or discounted after selecting the shipping area.

The prices displayed on the platform may be reviewed and modified at any time as they are subject to changes in the market.

PAYMENT METHODS

The purchases of the products and services can be paid by bank transfer, credit or debit card, Paypal or Bizum and the collection will be managed by a payment gateway of a secure server such as Redsys or PayPal.

All your data will travel encrypted and on a secure server SSL (Security Socket Layers), which guarantees that neither the owners of this Virtual Trade nor third parties will have access to your bank or credit card details.

Once the data has been introduced, the bank will validate your credit card and proceed to the payment. At that moment the order will be effective and will be processed and sent.

SHIPPING AND DELIVERY

Each of the products that appear on the website with their unit price corresponds to the total price, including taxes and does not include transport and customs charges.

The expenses derived from the shipment and customs will be in charge of the client, informing him at any moment before accepting the order of the exact expenses of shipment that are derived from the same one. The products purchased will be delivered to the natural or legal person and at the address indicated, within the time limit for each type of shipment.

The shipments will be delivered in an approximate time of 5 -15 days for the national territory from the reception of the payment and according to availability of stock through a company specialized in shipments.

For the purposes of the days required for delivery of the order, Saturdays, Sundays and public holidays (both national and local) will not be counted.

If the product is not in stock, the delivery time may be delayed by the time it takes to restock. In this case, Deco for Curious, declines all responsibility and will inform the customer of the estimated time of replacement and subsequent delivery.

No orders will be served at post office boxes and reserves the right to withhold shipment of orders with wrong addresses. In any case, we will contact you according to the data provided for any incident or doubt that may arise in the processing of your order.

AVAILABILITY

Deco for Curious will do its best to please all its customers in the demand of the products.

In case of unavailability of the product after the order has been placed, the customer will be informed by e-mail of the cancellation of the order.

SHIPPING COSTS

Deco for Curious currently delivers throughout Europe and in Spain

The shipping costs will be made according to the specifications of the product and the shipping company. These costs will be notified to the client before the payment of the product.

Note-Customs:

The sale of our products outside the Peninsular territory to countries of the European Union, are exempt from VAT (Except if the total value of annual sales to that country is below the limit established by its authorities). However, the customs system will apply the tax charges corresponding to each customs office, which will always be paid by the customer at the time of delivery of the package.

In no case can we calculate the amount to be paid a priori, since they depend on the regulatory bodies of each of the countries of destination and their customs.

You can contact your local customs office to request detailed information about these charges.

REFUNDS AND RETURNS

If you wish to return a product you have purchased from us, you may do so at any time up to 14 calendar days (as established in the Revised Text of the General Law for the Defence of Consumers and Users and other complementary laws) after the date of receipt of the order.

The circumstances that may lead to a return are as follows:

– In case of defective product caused by transport: If the customer notices any damage to the packaging at the time of collection or delivery of the product must reflect it in the delivery document of the carrier, and immediately communicate the incident to the email address. If this incident is detected once the customer has opened the product, has a period of 7 calendar days to communicate it.

In the case of receipt of a product that, by mistake, does not correspond to the requested must be communicated within 7 calendar days.

In any case, the products must be in perfect condition, sealed and in their original packaging; for example, the article must have all its packaging and security seals intact. No changes or returns will be accepted for products that have been opened or used for hygienic and sanitary reasons, unless they are in poor condition.

All returned packages must be identified with a return number, which must be requested by email to barbara@decoforcurious.com. This request must mention the invoice number of the original order. The date that Deco for Curious receives a request for a return number via email is considered the date of the return notification. Deco for Curious will not accept any package sent without a return number or any returned package with postage due. Returned parcels must be addressed to Deco for Curious.

When we receive the product in our plant we will proceed to verify the state of the product. In case the product does not correspond to the order placed or is defective, the amount paid will be refunded or the same product will be sent free of charge to the customer. If the product is not in good condition or has been tampered with, we will proceed to refund the cost of the product by deducting the cost of shipping the return.

The return cost caused by the returned products under the circumstances mentioned above will be paid by Deco for Curious. If the reason for the return is due to dissatisfaction on the part of the client, Deco for Curious will only take charge of the reimbursement of the amount of the products, but not of the expenses of shipment nor of return.

Deco for Curious, once received the merchandise in conformity with the previously exposed and effected the due verifications will proceed to the refund to the Client.

Within 14 calendar days after the verification of the return of the products, Deco for Curious will proceed to the reimbursement of the amount paid, which will always be made through the same method of payment with which the purchase was made. In the case of withdrawal, the expenses caused by the return of the products, will be paid by Deco for Curious according to what is established in the Revised Text of the General Law for the Defense of Consumers and Users and other complementary laws.

No client details sent in the payment section of www.decoforcurious.com are shared or passed on to third parties, with the exception of the companies used by Deco for Curious for order processing and shipping. Contact information and addresses are used only to process orders. Deco for Curious strictly adheres to applicable laws regarding the confidentiality of personal information.

In accordance with the Spanish law related to the protection of personal data provided online, Deco for Curious’s customers may have access to their personal data which they may modify or delete. The responsibility assumed by Deco for Curious will be restricted to the correction in the terms previously exposed. The company will not be responsible for the accessory damages that, eventually, are derived from the execution of the services. By way of illustration and not limitation, this category includes damages for loss of data, files, images, information, opportunities or benefits and moral damages.

Likewise, it shall not assume any liability for any difference in color between the original image and that of the product supplied, caused by a defective quality of the original image file. Claims for reasons of aesthetic taste will not be considered as defects in things.

The warranties and responsibilities provided in this clause shall not apply when the defect is due to force majeure or a cause attributable to the customer. In any case, the guarantee offered here replaces any other guarantee.

The regime foreseen in this clause will not be enforceable against persons acting as consumers in accordance with Spanish law, as long as a Judge or Court considers that the limitations foreseen here are contrary to the basic rights of the consumer. The same rule shall apply in cases where intent or gross negligence in the performance of the services is found.

WARRANTY

The guarantees and after-sales services will be governed by the Royal Legislative Decree 1/2007 of 16 November which approves the text of the General Law for the Defence of Consumers and Users. In accordance with this regulation, the seller is obliged to deliver to the consumer and user products that are in conformity with the contract, responding to him for any lack of conformity.

MODIFICATION OF THE TERMS AND CONDITIONS

Deco for Curious reserves the right to modify these Terms and Conditions at any time with a new version of the Terms and Conditions published on its website at www.decoforcurious.com. The Terms and Conditions applicable to any order are those published on www.decoforcurious.com on the date of the order.

The failure of Deco for Curious to exercise or delay in exercising any right provided by these Terms and Conditions does not constitute a waiver of that right or a waiver of any other rights. No partial exercise of a right under these Terms and Conditions shall prevent any subsequent exercise of the right or the exercise of any other right.

LIABILITY, APPLICABLE LAW AND JURISDICTION

Deco for Curious shall not be liable for failure to comply with any obligation under these Terms and Conditions in the event of force majeure or any circumstance beyond its reasonable control, such as, but not limited to, fire, flood, act of God, government regulations, strikes, epidemics, pandemics, riots or similar, or shortage of supplies.

These Terms and Conditions and all matters arising from or relating to them shall be governed by the law of Spain.

For the resolution of all disputes or questions related to this website or the activities carried out on it, Spanish law will be applicable, to which the parties expressly submit themselves, with the Courts and Tribunals of the city of Bilbao being competent for the resolution of all disputes arising from or related to its use.
